In 2016, the Department of Labor announced changes to FLSA regulations, increasing the minimum salary threshold for exempt employees from $23,660 to $47,476.
Aug. 31, 2017, a Texas court ruled the changes invalid. The ruling was appealed. However, the DOL asked the court to hold the appeal in abeyance (suspended), buying it time to make updates.
The Trump administration is working on proposed regulations with a new threshold expected to be between $30,000-$35,000. Employers should operate under the original rule but watch for updates. The DOL intends to issue a proposed rule sometime in 2018.
