Nursing home falls and your legal options

According to the CDC, 1 out of 4 adults 65 and older will fall each year. If a family member’s fall in a nursing home leads to serious injuries or a tragic death, the facility may bear legal responsibility for medical malpractice or a related offense.

• What are the facility’s safety policies?

• Did the resident have a caregiver with them? What did they do to prevent the fall?

• Were there other unreported falls?

Rightly or wrongly, falls are expected of older people – but sometimes they are preventable and you may have a case.
