Airbnb, other short-term rentals could face more regulation

In most states, there are no outright prohibitions on short-term leases. However, homeowners offering properties through sites like Airbnb and VRBO may have to contend with local zoning regulations.

The courts’ reluctance to shoehorn new uses into previously existing prohibited categories may lead to the development of new ordinances regulating short-term rentals. Cities like LA have already enacted regulations.

The likelihood that similar restrictions and regulations will be promulgated locally will require both legal and practical analysis so homeowners may continue the practice of renting their properties on a short-term basis.
